We collect personal data using various forms of communication, depending on the situation and needs. This may occur in particular during:

  • looking for employment in our Company or other entity belonging to the ASM GROUP Capital Group,
  • e-mail or telephone contact, also using the form provided on our website www.asmgroup.eu
  • we consider cases individually regarding the data subject, e.g. as a result of an application, question, complaint or complaint,
  • correspondence carried out both in electronic and traditional paper form, for example in order to consider the request, application, complaint, answering questions and requests,

Personal data that will allow us to identify an indicated person or contact him, are collected when they are provided voluntarily by the person they refer to or by another entity on the basis of the explicit consent of the person they refer to, as well as when the requirement to provide data is a statutory, contractual obligation or a condition of concluding a contract. We can only transfer your data to the following groups of entities:

  • persons authorized by us - our employees, associates who must have access to data to perform their duties,
  • entities processing data on our instructions - to whom we will order activities that require data processing, for example, our contractors, subcontractors, to whom we will have to provide your data to properly perform the service, confirm the manner of its implementation or consider the complaint,
  • entities authorized to obtain data under applicable law, e.g. courts or law enforcement authorities,

Do we send your personal data outside the European Union?

We may transfer your personal data to other countries, including countries outside the European Economic Area ("EEA"), which may not have the same data protection provisions as the laws in force in Poland. Do you have to submit data?

In most cases, you are not required to provide us with any personal information. In some situations, the obligation to provide specific data results directly from legal provisions. Failure to provide your data may result in us being unable to enter into a contract with you, provide you with services, provide adequate services, answer your complaint or fulfil your request to answer the question.

How do we secure your personal data?

We use technical and organizational measures to protect your personal data against accidental or intentional loss, destruction or access by unauthorized persons. Right to erasure (`right to be forgotten`)

The data subject has the right to request us the erasure of personal data concerning him or her without undue delay, whenever the data is no longer necessary for the purposes for which it was collected, when he or she withdrew the consent to the processing of personal data, when the data subject objected to the processing of his or her data or data is processed unlawfully.

Right to restrict processing

The data subject has the right to request us to limit data processing when questions the correctness of the data, the processing is unlawful, we no longer need the data for the purposes of processing or has objected to the processing.

  1. the conclusion and implementation of the contract (the basis of Article 6 paragraph 1 point b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46 / EC (General Data Protection Regulation) (hereinafter: GDPR)

Data storage period: We will store your personal data for the limitation period of the tax liability, i.e. for a period of 5 years from the end of the calendar year in which the tax payment deadline under the contract expired. We will store data processed for the purpose of pursuing claims (e.g. in court proceedings) for the period of limitation of claims, resulting from the provisions of the Civil Code.

Your rights: You have the right to access your data, the right to rectify, erasure, restriction of processing, the right to request their transfer and object to data processing based on our legitimate interest.   1. the implementation of obligations under labor law, in particular the Act of 26 June 1974 Labor Code, executive ordinances issued on the basis of the above-mentioned legal act and social security and social protection (basis from Article 6 paragraph 1 letter c) and Article 9 item 2 lit. b) Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46 / EC (General Regulation on the Protection of data) (hereinafter: GDPR);
  2. taking action before the conclusion of the contract with you and performance of obligations arising from the contract concluded with you (the basis of Article 6 para. 1 lit.b) GDPR);
  3. implementation of our so-called legitimate interests consisting in the proper consideration and handling of any complaints, inquiries (the basis of Article 6 (1) (f) GDPR);
  4. possible determination, investigation or defence against claims being the implementation of our so-called legally justified in this interest, consisting in seeking and defending our legitimate interests (basis from Article 6 (1) (f));
  5. the implementation of our so-called legitimate interests consisting in ensuring the organization of work enabling full use of working time, proper use of the work tools made available to the employee (the basis of Article 6 (1) (f) of the GDPR);
  6. improve communication in business relations and internal communication management, which is the implementation of our so-called legitimate in this interest (the basis of Article 6 para. 1 lit. f) GDPR);
  1. Recipients of data: We may pass your data to:

  1. Data storage period: We will store your personal data that is part of the personal file for 50 years, as required by law. We will keep the remaining data for the period of limitation of claims from the employment relationship, i.e. for a period of 3 years from the date on which the claim became due.
  2. Your Rights: You have the right to access your data, the right to rectify it, erasure, restriction processing, as well as the right to object when we process the data based on our legitimate interests, as indicated above. However, if we process data in connection with the contract concluded with you, you also have the right to request their transfer. You can exercise the above rights using the contact details indicated above. If you find that the processing of personal data violates the provisions of the GDPR, you also have the right to lodge a complaint with the President of the Office for Personal Data Protection.
  3. Voluntariness / obligation to provide data: Providing your data to the extent required by labor law and executive laws is a statutory requirement, you are required to provide them, and the remainder is voluntary. Failure to provide the data required by law will prevent us from concluding an employment contract with you and its implementation.
